It is strictly forbidden to build or expand photovoltaic power generation projects to occupy permanent basic farmland, basic grasslands, Ⅰ protected forest land and key state-owned forest areas in Northeast China and Inner Mongolia. Photovoltaic phalanx land is strictly prohibited to occupy cultivated land. The existing agricultural land that cannot be restored to its original use due to coal mining collapse may be changed into other types of agricultural land or unused land after verification by the Natural Resources Department of the autonomous region in conjunction with the relevant departments and with the consent of the land right holder and submitted to the Ministry of Natural Resources for approval, and shall be managed according to the changed land category. For the construction land of open-pit mine dump obtained in accordance with the law, after the acceptance of reclamation, the non-arable land can be used for photovoltaic power generation project construction.
